AGREEMENT TO TERMS

By accessing our website (http://oaklandautoglassca.com), visiting our physical location, or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Low Price Auto Glass reserves the right to modify these terms at any time. Your continued use of our services after any changes indicates your acceptance of the new terms.

SERVICES DESCRIPTION

Low Price Auto Glass provides Low Price Auto Glass repair and replacement services, including:

  • Windshield chip repair
  • Windshield replacement
  • Side and back window replacement
  • Power window repair
  • Window tinting
  • ADAS calibration
  • Related Low Price Auto Glass services

QUOTES AND PRICING

Quote Validity:

  • •Quotes provided by phone, email, or in-person are estimates based on information you provide
  • •Final pricing may vary if actual vehicle condition or service requirements differ from initial description
  • •Quotes are valid for 30 days from date of issue

Pricing Factors:

Prices vary based on:

  • Vehicle year, make, and model
  • Type of glass (new OEM, new aftermarket, used OEM)
  • Complexity of installation
  • Additional services required (ADAS calibration, etc.)
  • Parts availability

Price Changes:

We reserve the right to adjust pricing if:

  • • We discover additional damage during service
  • • Parts availability or costs change
  • • Additional services are required for safe installation

You will be notified of any price changes before we proceed with the work.

PAYMENT TERMS

Payment Due:

Payment is due upon completion of services unless other arrangements have been made in advance.

Accepted Payment Methods:

  • Cash
  • Credit cards (Visa, Mastercard, Discover, American Express)
  • Debit cards
  • Insurance payments (we bill directly)

Insurance Claims:

  • •You are responsible for your deductible and any charges not covered by insurance
  • •We bill your insurance company directly for covered services
  • •You are ultimately responsible for payment if insurance does not pay

Late Payments:

  • • Past due accounts may be subject to late fees
  • • We reserve the right to use collection services for unpaid balances

APPOINTMENTS AND CANCELLATIONS

Scheduling:

  • Appointments are recommended but not always required
  • We will make reasonable efforts to accommodate your preferred date and time
  • Appointment times are estimates and may vary

Cancellations:

  • •If you need to cancel or reschedule, please contact us at least 2 hours in advance
  • •Last-minute cancellations (less than 2 hours notice) may result in a cancellation fee
  • •No-shows may be charged a $50 fee

Our Right to Cancel:

We reserve the right to cancel or reschedule appointments due to:

  • • Weather conditions
  • • Parts availability
  • • Emergency situations
  • • Staffing issues

We will make reasonable efforts to notify you as soon as possible.

WARRANTY INFORMATION

Parts and Labor Warranty:

We provide warranty coverage on qualifying repairs and services as follows:

Coverage:

  • Defects in materials (glass, adhesives, parts)
  • Installation workmanship
  • Proper seal and fit
  • Functionality of installed components

Duration:

Varies by service type and materials used. Specific warranty terms will be provided at time of service.

What's NOT Covered:

  • Damage from accidents after installation
  • Damage from improper use or care
  • Damage from external sources (rocks, vandalism, etc.)
  • Normal wear and tear
  • Damage from alterations or repairs by others
  • Consequential or incidental damages

Window Tinting Warranty:

Lifetime warranty against bubbling, peeling, fading, and discoloration due to film defects or installation errors.

Warranty Service:

To make a warranty claim:

  4. 4. We'll repair or replace at no charge if covered by warranty

LIMITATION OF LIABILITY

To the Maximum Extent Permitted by Law:

Low Price Auto Glass and its employees shall not be liable for:

  • •Indirect, incidental, special, or consequential damages
  • •Loss of profits, revenue, or data
  • •Damage to vehicle beyond the scope of services provided
  • •Delays in service or parts availability
  • •Acts of God, weather, or circumstances beyond our control

Our Total Liability:

Our total liability for any claim related to our services shall not exceed the amount you paid for those specific services.

Vehicle Condition:

We are not responsible for pre-existing damage to your vehicle, rust, deterioration, or issues discovered during service that are unrelated to the services we provide.

CUSTOMER RESPONSIBILITIES

You Agree To:

  • Provide accurate information about your vehicle and service needs
  • Disclose any previous damage or repairs
  • Remove personal belongings from your vehicle before service
  • Arrive on time for scheduled appointments or notify us of delays
  • Pay for services when due
  • Follow care instructions provided after service
  • Not drive your vehicle before the recommended cure time after windshield replacement

Vehicle Security:

While we take reasonable precautions to protect your vehicle while in our care, you are responsible for removing all valuables. We are not responsible for theft or damage to personal property left in your vehicle.

ADAS CALIBRATION

If your vehicle requires ADAS calibration after windshield replacement:

  • •You acknowledge that calibration is necessary for proper operation of safety systems
  • •Declining calibration service may result in safety system malfunctions
  • •You waive any claims against Low Price Auto Glass related to uncalibrated ADAS systems if you decline calibration service
  • •You acknowledge that manufacturer warranties may be voided without proper calibration

USED PARTS AND GLASS

When you choose used OEM parts or glass:

  • •Parts are inspected for quality but are pre-owned
  • •Parts are sold "as-is" with limited warranty
  • •We make reasonable efforts to ensure quality but cannot guarantee the history of used parts
  • •Used parts may have cosmetic imperfections that don't affect functionality

INTELLECTUAL PROPERTY

All content on our website, including text, graphics, logos, images, and software, is the property of Low Price Auto Glass or its content suppliers and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our website content without explicit written permission.

INDEMNIFICATION

You agree to indemnify and hold harmless Low Price Auto Glass, its employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • •Your violation of these Terms of Service
  • •Your violation of any rights of another party

DISPUTE RESOLUTION

Informal Resolution:

If you have a complaint or dispute, please contact us first at (510) 568-7131 or oaklandautoglass1@gmail.com. We will make reasonable efforts to resolve the issue informally within 30 days.

Most disputes can be resolved quickly and amicably through direct communication. We are committed to customer satisfaction and will work with you to find a fair solution.

Binding Arbitration:

If a dispute cannot be resolved informally, you and Low Price Auto Glass agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms of Service or our services through binding arbitration, rather than in court.

Arbitration Process:

  • •Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) or a similar arbitration service
  • •Arbitration will take place in Alameda County, Oakland
  • •The arbitrator's decision will be final and binding
  • •Each party will bear their own attorney fees and costs, unless the arbitrator determines otherwise

Exception: Either party may bring a claim in small claims court if the claim qualifies, or seek injunctive relief in court for intellectual property violations.

Class Action Waiver:

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits, class-wide arbitrations, or any other representative proceeding.

This means you may only bring claims against us in your individual capacity, and not as a plaintiff or class member in any class or representative action.

GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Jurisdiction:

Any legal action or proceeding relating to these terms shall be brought exclusively in the courts of Alameda County, California.

SEVERABILITY

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Low Price Auto Glass regarding use of our services.
